An Act for constituting Commissioners of Railways, 9 & 10 Vict. c. 105

Claims Supported by This Source

  1. Enacted August 28, 1846. Preamble and Articles 1–2: Powers relating to railways that belonged to the Board of Trade under the Acts of 1840, 1842, 1844 (7 & 8 Vict. c. 85), and the Consolidation Acts of 1845, etc., are transferred to not more than five Commissioners of Railways appointed by the Crown. The President may be a Member of the House of Commons (Article 7).
  2. Article 6: The salary of the President shall not exceed £2,000, and that of the two paid Commissioners shall not exceed £1,500 each. Article 9: It is the duty of the Commissioners to stop a company when it exceeds its legal powers.
  3. Articles 10–11: Regarding railway schemes referred by the Crown or either House of Parliament, they shall investigate and report on the existence of competing lines, powers of amalgamation or sale, branch lines, and the correctness of submitted plans, and may conduct local inspections. The costs are to be borne by the provisional committeemen or directors. Article 12: This Act may be amended or repealed by any Act of the present session.
