  1. From October 1, 2023, stealth marketing will be a violation of the Act against Unjustifiable Premiums and Misleading Representations.
  2. Stealth marketing is the practice of hiding the fact that something is an advertisement, even though it is.
  3. Consumers make choices assuming that corporate advertisements may contain exaggeration, but if they do not recognize something as an ad, they may mistake it for the opinion of a third party and accept the content at face value.
  4. The regulation applies to advertisements that general consumers cannot recognize as such. This includes content that companies request or instruct third parties, such as influencers, to create. In addition to social media posts and reviews, displays on TV, newspapers, radio, and magazines are also covered.
  5. Content that is not an advertisement, such as personal opinions, and content clearly identifiable as an advertisement, such as TV commercials, are not subject to the regulation.
  6. The regulation targets only the business operators (advertisers) who supply the products or services; third parties who are commissioned, such as influencers, are not subject to the regulation.
